TERMS AND CONDITIONS FOR EVENT ORGANIZERS

These Terms and Conditions (the "Agreement") regulate the use of TicketeraPropia.com by event organizers, producers, or venue owners ("you," "your," or "Organizer"). By accessing or using our platform to sell tickets and manage events, you agree to comply with these Terms and Conditions. If you do not agree, you must not use our services.

1. DEFINITIONS
  • Platform: The TicketeraPropia.com online system that allows Organizers to create their own ticketing system.
  • Customers: End-users who purchase tickets for events created by Organizers.
  • Service Fees: The fees charged by TicketeraPropia.com for providing the platform.
  • Chargebacks & Disputes: Situations where Customers dispute a transaction with their payment provider.
2. SERVICE DESCRIPTION
  • TicketeraPropia.com provides a white-label ticketing platform that enables you to sell tickets under your own brand. You acknowledge that we are solely a technology provider and do not act as an event promoter, seller, or merchant of record.
  • Non-Exclusivity
    • The use of the Platform by the Organizer is non-exclusive.
    • The Organizer is free to use other platforms or methods for ticket sales without any restrictions from TicketeraPropia.com.
3. ACCOUNT REGISTRATION & RESPONSIBILITIES
  • You must provide accurate information when registering.
  • You are responsible for managing your ticketing system and ensuring compliance with applicable laws.
  • You must maintain the confidentiality of your login credentials and are responsible for all activities under your account.
  • You may not use our platform for illegal, fraudulent, or misleading purposes.
4. FEES AND PAYMENT TERMS
  • TicketeraPropia.com charges service fees for the use of the platform. These fees will be clearly displayed in your account settings.
  • Fees are deducted from ticket sales before funds are transferred to your payment processor.
  • You are responsible for setting ticket prices and any additional fees charged to Customers.
  • We reserve the right to modify our fee structure with prior notice.
5. PAYMENT PROCESSING & REFUNDS
  • The Platform allows Organizers to accept online payments through third-party payment processors ("Payment Processors"). Currently, available Payment Processors include Stripe, PayPal, and Square.
  • To use these services, the Organizer must create an account directly with the Payment Processor of their choice and accept their terms and conditions and privacy policies.
  • The Payment Processor acts as a data processor for both the Organizer and TicketeraPropia.com in some aspects but operates as a data controller according to its own privacy policies in others.
  • By using the Platform's payment services, the Organizer agrees that TicketeraPropia.com may share relevant transaction information with the Payment Processor.
  • If a Payment Processor detects fraudulent activity, terms violations, or suspicious transactions, TicketeraPropia.com may suspend access to the payment services and/or the Organizer's account.
  • TicketeraPropia.com assumes no liability for problems, losses, costs, or penalties arising from services provided by the Payment Processor.
  • You are solely responsible for handling refund requests from Customers.
  • TicketeraPropia.com is not liable for chargebacks, disputes, or fraudulent transactions.
  • If a Customer disputes a transaction, you must provide the necessary evidence to the payment provider.
6. DATA PROTECTION AND COMPLIANCE WITH GDPR & CCPA
  • The Organizer is solely responsible for the collection, storage, and management of Customers' personal data.
  • TicketeraPropia.com does not store or process personal data of Customers on behalf of the Organizer.
  • The Organizer must comply with all applicable data privacy and protection laws, including the General Data Protection Regulation (GDPR) in the European Union and the California Consumer Privacy Act (CCPA) in the United States.
  • The Organizer must provide Customers with clear information about data usage and comply with requests for access, deletion, or restriction of personal data in accordance with applicable laws.
7. EVENT MANAGEMENT & COMPLIANCE
  • You are responsible for ensuring that your events comply with all applicable laws and regulations.
  • You must provide accurate event details and honor all valid tickets sold through the platform.
  • TicketeraPropia.com is not responsible for event cancellations, changes, or disputes between you and Customers.
8. TERMINATION OF SERVICE
  • TicketeraPropia.com may terminate the service if the Organizer fails to comply with these Terms and Conditions.
  • The Organizer may cancel their account at any time; however, no refunds will be provided for fees already paid.
  • TicketeraPropia.com reserves the right to modify, suspend, or discontinue the Platform at any time.
9. CONTENT AND ACCEPTABLE USE STANDARDS
  • The Organizer is solely responsible for the legality, reliability, integrity, accuracy, and quality of all content uploaded to the Platform ("Organizer Content").
  • The Organizer must ensure that its content complies with all applicable laws and does not contain excessive or unnecessary information, including sensitive or confidential data that is not strictly necessary for event management.
  • The Organizer’s content must not:
    • Be illegal, harmful, threatening, defamatory, obscene, deceptive, or fraudulent.
    • Facilitate illegal activities or promote violence.
    • Infringe upon third-party intellectual property rights.
    • Be discriminatory or morally objectionable.
10. INTELLECTUAL PROPERTY
  • You retain ownership of your brand, content, and event-related materials.
  • By registering, you grant TicketeraPropia.com the right to use their logo in marketing materials, unless they explicitly request to opt out of this use.
  • By uploading content, the Organizer grants TicketeraPropia.com a non-exclusive, transferable, royalty-free, worldwide license to use such content in connection with providing the service.
  • By using our platform, you grant TicketeraPropia.com a non-exclusive, worldwide license to use your event details for promotional purposes.
  • TicketeraPropia.com retains all rights to its platform, software, and branding.
11. USE OF THE MOBILE APPLICATION
  • TicketeraPropia.com offers a mobile application that allows event staff and collaborators to monitor events, scan tickets, and manage event access.
  • The application is provided "as is" and may be updated or modified at any time without prior notice.
  • Organizers are responsible for ensuring that only authorized personnel access and use the mobile application.
  • TicketeraPropia.com is not responsible for technical issues, connectivity problems, or any improper use of the mobile application.
  • The application may require device permissions (e.g., camera access for scanning tickets), and it is the Organizer’s responsibility to ensure proper configuration.
12. LIMITATION OF LIABILITY & INDEMNIFICATION
  • Although TicketeraPropia.com strives to ensure service availability 24/7, we do not guarantee uninterrupted access.
  • The Platform is provided "as is" and does not guarantee continuous, error-free operation.
  • TicketeraPropia.com is not responsible for any financial losses resulting from service failures, technical issues, or integration errors with third parties.
  • Our total liability, under any circumstances, is limited to the amount paid by the Organizer in the last three months.
Indemnification
  • The Organizer agrees to indemnify, defend, and hold harmless TicketeraPropia.com, its affiliates, directors, employees, and agents against any claims, demands, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:
    • (a) Misuse of the Platform.
    • (b) Violation of these Terms and Conditions.
    • (c) Any breach of applicable laws related to ticket sales or event management.
    • (d) Disputes, claims, or demands from the Organizer’s Customers.
    • (e) Any infringement of third-party rights.
  • This indemnification obligation shall survive even after the termination of the Organizer's use of the Platform.
13. DISPUTE RESOLUTION
  • Any disputes between you and TicketeraPropia.com will be resolved through arbitration in Los Angeles, California.
  • You agree to waive any right to participate in class-action lawsuits against us.
14. MODIFICATIONS TO THESE TERMS
  • We may update these Terms from time to time. Changes will be notified via email or posted on our platform.
  • Continued use of the platform after modifications constitutes acceptance of the revised Terms.

By using TicketeraPropia.com, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

15. MISCELLANEOUS
  • Severability: If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect. The parties agree to replace any invalid provision with a valid provision that most closely achieves the original intent.
  • Entire Agreement: This Agreement constitutes the entire understanding between TicketeraPropia.com and You regarding the use of the Platform. It supersedes all prior agreements, negotiations, representations, or communications, whether written or oral.
  • No Waiver: Failure by either party to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other rights under this Agreement.
  • Assignment: You may not assign or transfer any of Your rights or obligations under this Agreement without prior written consent from TicketeraPropia.com. TicketeraPropia.com may assign its rights and obligations in connection with a merger, acquisition, or other business restructuring without notice.
  • Independent Contractors: The relationship between TicketeraPropia.com and You is that of independent contractors. Nothing in this Agreement shall be construed as creating a partnership, joint venture, agency, or employment relationship between the parties.
